1. Acceptance of Terms

By accessing our website at alisesystems.com or using any ALISE Systems service (collectively, the "Services"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree, please do not use our Services.

These Terms apply to all visitors, users, and customers, including family members, caregivers, and home care providers.

2. Description of Services

ALISE Systems provides a non-camera, non-wearable home monitoring solution that uses discreet sensors to track activity patterns and deliver daily summaries and alerts to authorized contacts. Our Services include sensor hardware, software, installation support, and human-reviewed alert monitoring.

3. Eligibility

You must be at least 18 years old to purchase or use our Services. By agreeing to these Terms, you represent that you are 18 years of age or older and have the legal authority to enter into this agreement.

4. Account and Order Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when placing orders or creating an account
  • Notify us promptly of any unauthorized access or security breach
  • Use the Services only for their intended purpose of monitoring the safety and wellbeing of a consenting adult

5. Consent and Privacy of Monitored Individuals

You represent and warrant that you have obtained the informed consent of any individual whose home will be monitored by ALISE sensors. You agree not to use ALISE Services to monitor any person without their explicit knowledge and agreement.

ALISE Systems is not responsible for any misuse of the Services or any failure to obtain proper consent.

6. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of our systems or data
  • Resell, redistribute, or sublicense the Services without written authorization from ALISE
  • Interfere with or disrupt the integrity or performance of the Services
  • Use the Services to monitor any individual who has not provided explicit consent

7. Payment and Billing

By placing an order, you authorize ALISE Systems to charge your payment method for the applicable fees. All fees are stated in US dollars. Subscription fees, if applicable, are billed on a recurring basis until cancelled.

Refund eligibility is determined by our refund policy available at alisesystems.com. Hardware returns must be made within 30 days of delivery in original condition.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ALISE SYSTEMS DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALERTS WILL BE DELIVERED IN A SPECIFIC TIMEFRAME.

ALISE IS NOT A MEDICAL DEVICE PROVIDER AND THE SERVICES ARE NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL CARE, EMERGENCY SERVICES, OR IN-HOME CAREGIVING.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ALISE SYSTEMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless ALISE Systems, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

11. Modifications to the Services and Terms

ALISE Systems reserves the right to modify or discontinue the Services at any time with reasonable notice. We may also update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall first be submitted to good-faith negotiation, and if unresolved, to binding arbitration in accordance with the rules of the American Arbitration Association.
